Ban the use of Counselling Notes in Rape and Gender-based Violence Criminal Trials:
“Éist is a survivor-led organisation advocating for and providing trauma informed services to all victims and survivors of sexual violence. Our core campaign seeks to see the use of counselling and therapy notes banned in criminal trials involving rape and gender-based violence.
At present, this practice allows the defence – and the person a victim or survivor believes harmed them – access to deeply personal counselling notes. We believe these notes are accessed not because they hold evidentiary value, but to belittle, discredit, and make a spectacle of the victim/survivor. A counsellor was not present at the scene of the crime and cannot provide a factual account of what occurred. These are third-party, interpretive notes, often presented without context or background, yet they can be profoundly damaging.” – Éist
